The US Court of Appeals Overturns a Ban on Sales of Samsung's Galaxy Nexus Phone Granted

The US Court of Appeals has overturned a ban on sales of Samsung's Galaxy Nexus phone granted in June after an application by Apple in the patent dispute war between the rival companies.

The court found that the district court in California that issued the ban had"abused its discretion in entering an injunction".

US Lifts Ban on Samsung Galaxy Nexus

Earlier this month,a sales ban also imposed in June on Samsung's Galaxy Tab 10.1 tablet computer in the US was also lifted.

Samsung welcomed the Appeals Court ruling."It confirms that the role of patent law is to protect innovation and not to unreasonably stifle competition and restrict consumer choice,"the company said in a statement.

"We will continue to take all appropriate measures to ensure the availability of our innovative products,"Samsung said.

In August,a South Korean court ruled that Apple and Samsung Electronics infringed each other's patents.

Both parties were ordered to pay compensation,but a week later,a California court awarded Apple$1bn in damages for copying key elements of Apple iPhone.

Samsung has since challenged that verdict and called for a retrial.

Analysts predict that the legal battle between the two firms is likely to continue because of the tremendous growth potential of the smartphone and tablet market.

"The intensity of the competition is so high,it is less about billions of dollars in fines,and more about slowing the competition,"Manoj Menon,managing director of Frost&Sullivan,told the BBC.

Apple believes that Samsung's patent infringement has played a role in the South Korean firm's success,and Apple will do whatever it can to slow Samsung's growth,he said.
