US Initiates “337 Investigation” on Huawei, ZTE, Samsung and Nokia Wireless Devices

On January 31, the U.S. International Trade Commission announced "337 investigations" on some 3G and 4G wireless equipment company, including Huawei, ZTE, Samsung and Nokia, to determine whether their products infringe the patents of U.S. companies. This is the 4th "337 investigation" the United States initiated on Chinese companies this year.

The U.S. International Trade Commission said in a statement, involved products are mainly network equipments on mobile phones, mobile computer card, mobile USB, PC and other mobile features.

The Statement said, four US mobile devices company filed complaints to the U.S. International Trade Commission on January 2, accusing infringement by above involved products. The companies required to start the "337 investigation" and issue an exclusion order and import forbidding order.

According to relevant procedures, the U.S. International Trade Commission must determine the final ruling as soon as possible in 45 days on the start of the "337 investigation". Usually the case needs to be adjudicated within a year. If the enterprises involved are convicted of a violation of section 337, the U.S. International Trade Commission will publish the exclusion order and injunction for related products. This means that involved products will lose the right of sales in the U.S. market.
