Nestle Sues Pervine Foods Over Trademark Infringement

Nestle US has reportedly filed a lawsuit against Pervine Foods, the manufacturer of Fit Crunch protein bars, as the former found the packaging of Fit Crunch bars to be too similar to its own Crunch bars.

Nestle filed a lawsuit against Pervine Foods for infringing marks, trade dress.

Other accusations that Nestle put forth against Pervine Foods were false designation of origin, and unfair competition.

Nestle claimed in the lawsuit that consumers could easily mistake Fit Crunch for Nestle's Crunch bars, or a low calorie version of the same, reported FoodDive.com.

Nestle has sought punitive damages and has stated that "Pervine seems to have blatantly copied key elements of Nestle's Crunch Trade Dress", reported Food Navigator USA. Pervine Foods has not yet responded to the claims.
