Those with businesses in either dietary supplements, health supplements, functional foods, sports foods, fortified foods, medical foods, products with novel ingredients, complementary medicines or therapeutic products must be ready for regulatory changes that can help or hinder their business.

Complementary medicines or supplements are threatened by new TGA criteria with de-listing from the ARTG. Being off the ARTG will make life difficult for many products unless they switch into a regulatory route alternative to the TGA.

While the Health claims standard offers one regulatory route, food law experts and consultants FoodLegal said there can be other alternatives.

New Zealand law can offer some advantages for industry innovations by companies and businesses selling products into Australia. FoodLegal said there may be scope for food and beverage companies to utilise a favourable New Zealand regulatory framework that is also open to Australian suppliers and importers.
