Rambus illegally destroyed evidence in its long-running lawsuit with Hynix,a Californian court has ruled,and Hynix is not obliged to pay a previous court award of$397m for patent violation.
The$397m court award against Hynix was made by the Californian court in 2009.Hynix appealed and the US Court of Appeals told the Californian court to think again about the size of the award becasue of the destruction of evidence.
By the end of next month,the two firms must present proposals for a payment of'reasonable and non-discriminatory'royalties which Hynix should pay.
In January,a key Rambus patent was invalidated by the US Patents Office on the grounds of prior art which made the innovations described in the Rambus patent look'obvious'
The invalid patent was one of three,called the'Barth'patents,which have all now been found invalid.
