Apple Is to Press Home Its Recent US Court Victory Over Samsung

Apple is to press home its recent US court victory over Samsung by seeking injunctions against two current big-selling Samsung products that were not even cited in the recent court case.

It has filed an amended complaint with the US District Court for the Northern District of California,adding two versions each of the Galaxy S III and Galaxy Note to its original claims of patent infringement against a number of Samsung smartphones and tablets.

The injunctions,in a case due to be heard in December,could lead to the removal from sale in the US of Samsung's best-selling phones.The rest of the world,however,where Apple's intellectual property lawsuits have made little headway,would be unaffected.

The Galaxy SIII has been winning market share off of Apple's flagship iPhone 4S,selling more than 10 million units in its first quarter on sale.The Galaxy Note,too,is also popular in the US,with the latest version launched at the IFA technology fair in Berlin last week.

The products cited in the intellectual property infringement action,and originally named in the injunction,are largely obsolete.

The infringing products listed in the amended complaint now include:

Galaxy S III, Galaxy S III-Verizon,Galaxy Note,Galaxy S II Skyrocket,Galaxy S II Epic 4G Touch,Galaxy S II,Galaxy S II-T-Mobile,Galaxy S II-AT&T,Galaxy Nexus,Illusion,Captivate Glide,Exhibit II 4G,Stratosphere,Transform Ultra,Admire,Conquer 4G,Dart.

As well as:

Galaxy Player 4.0 and Galaxy Player 5.0 media players,Galaxy Note 10.1,Galaxy Tab 7.0 Plus,Galaxy Tab 8.9.

"While Samsung's new products infringe many of the same design patents,utility patents,trademarks,and trade dress rights that are at issue in the Earlier Case,Samsung's new products also infringe additional utility patents,some of which issued after Apple filed the Earlier Case...Apple is filing this suit to put an end to Samsung's continued infringement,"stated Apple in its amended filing.

It added:"Samsung released a series of products in 2010 and early 2011 that slavishly copied Apple's iPhone,iPod,and iPad products...Samsung continues to choose to infringe Apple's patent rights through the design and promotion of its mobile phones,tablet computers,and media players to trade upon the goodwill that Apple has developed in connection with its Apple family of mobile products.

"These infringing Samsung products include the at least 21 new smartphones,media players,and tablets that Samsung has released beginning in August 2011 and continuing through August 2012."
