Apple Has Followed up Its Recent Patent Victory Over Samsung

Apple has followed up its recent patent victory over Samsung, which saw it awarded $1.05bn (£650m) in damages by a Californian court, by filing a sweeping injunction late on 21 September against the sale in the US of dozens of Samsung smartphones and tablets, including its Galaxy brand.

The injunction covers "any of the infringing products or any other product with a feature or features not more than colorably different from any of the infringing feature or features in any of the infringing products".

According to Reuters, Apple has also asked for another $400m for design infringements, $121m in damages for sales Samsung won by infringing its patents and $135m for wilful patent-busting. Apple is even asking for $50m to cover interest on damages incurred before the judgement.

The total comes to $707m (£436m).

Samsung responded immediately by asking for an entirely new trial. "The court's constraints on trial time, witnesses and exhibits were unprecedented for a patent case of this complexity and magnitude," said Samsung, "and prevented Samsung from presenting a full and fair case in response to Apple's many claims.

"Samsung therefore respectfully requests that the court grant a new trial enabling adequate time and even-handed treatment of the parties."

Samsung also took the opportunity to dig its heels in over the ongoing argument of patent law interpretation, criticising part of the August ruling that pertained to the shape of Samsung products.

"It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies," said Samsung.

Before Friday's scuffles, and just prior to Apple's iPhone 5 launch, Samsung had already made public its intention to add the new Apple phone to its own ongoing patent lawsuits against the company, alleging that the iPhone 5 infringes a selection of Samsung patents.
