Kind Healthy Snacks, a natural foods company based in New York, and Garden of Life have reached a settlement related to a trademark infringement lawsuit brought by the former in response to Garden of Life's launch of the Kind Organics line of vitamins.
As per the deal, Garden of Life will be making substantial adjustments to its newest offering, which include changing the product line name to 'Garden of Life mykind Organics,' redesigning packaging, advertising and point of sale materials.
It will also not use certain slogans and has agreed not to seek trademark registration of the mykind Organics brand.
Kind vice president and general counsel Justin Mervis told foodbev.com that: "We pursued this settlement with the best interest of the consumer in mind after receiving numerous reports of confusion."
"As such, we are pleased to have reached an amicable settlement with Garden of Life and will continue to defend our distinctive trademarks and trade dress against any market entrants that cause consumer confusion in the marketplace," Mervis added.
Garden of Life noted that the rebranded lines of products are expected to be seen in the marketplace by January 2015.kj
