FMCSA Has Revoked a Mexico-Based Carrier's Authority to Do Business in The United States

The Federal Motor Carrier Safety Administration has revoked a Mexico-based carrier's authority to do business in the United States after a compliance review resulted in a "conditional" safety rating.

In the Dec. 20 review, officials found a number of safety areas in which Sergio Tristan Maldonado, who does business as Tristan Transfer, was deficient. The carrier violated regulations regarding records of duty status, maintaining driver qualification files and employing drivers whose drug and alcohol tests have not been returned, among other violations, FMCSA said.

Conditional ratings disqualify carriers from participating in FMCSA's cross-border pilot program that allows some Mexican fleets to operate throughout the United States. Tristan did not respond to FMCSA's proposed conditional rating, so its authority was revoked Jan. 23, the agency said in a letter released Feb. 10. It can request a review of the decision.

Tristan is the first carrier to have a conditional rating in the program that began in October 2011, FMCSA records show. Attempts by Transport Topics to contact Tristan were unsuccessful.
