Clear Lam Packaging and Frito-Lay have settled a lawsuit where Clear Lam had accused the latter of stealing a packaging design for its promotional boxes of Doritos.
As a part of the settlement, Frito-Lay has agreed to respect Clear Lam's patent rights.
In the original lawsuit that was filed on 18 September 2014, Clear Lam had claimed that the packaging designs made available to Frito-Lay had been used as the basis for packaging used to house 7oz servings of Doritos sold alongside Microsoft's new Xbox One console.
Clear Lam had claimed that the Doritos Gamer Pack uses a type of flexible film packaging that shares major aspects of its trademarked PrimaPak technology.
The Cook County Record quoted Clear Lam's lawsuit as saying: "The PrimaPak System includes a commercially viable method of producing a first of its kind cubed, flexible, recloseable package commonly used for a variety of consumer and industrial products.
"Among other things, the PrimaPak System is designed to replace traditional stand-up pouches, bags and a variety of preformed rigid containers such as plastic jars, cans, bottles and trays."
The lawsuit had further stated that the company's proprietary [shaping] technology is the product of several years of confidential research and development and is not known outside of Clear Lam.
With the settlement, the parties might continue to explore additional business opportunities using Clear Lam's PrimaPak technology.
However, specific terms of the agreement have not been disclosed.
